Nicotine addiction

Cécilia Létourneau v. Imperial Tobacco, Rothmans Benson & Hedges and JTI MacDonald

On September 10th, 1998, Ms. Cécilia Létourneau filed a Motion to institute a class action and to obtain the status of representative against Imperial Tobacco, Rothmans Benson & Hedges and JTI MacDonald, the three main tobacco companies in Canada.

The recourse taken by Ms. Létourneau seeks, among other things, to obtain compensation of 5000 $ as exemplary damages for each person addicted to the nicotine contained in cigarettes manufactured by the Respondents. The number of members in the group is estimated to be approximately 2 million. You may consult the Motion for further details.

On February 21th, 2005, Justice Pierre Jasmin authorized the class action and defined the group as following:

« All persons residing in Quebec who, at the time of the service of the motion [September 10th 1998], were addicted to the nicotine contained in cigarettes manufactured by the Respondents and who remained addicted, as well as the legal heirs of persons who were included in the group at the time of the service of the motion but later died without quitting smoking.” (translated from the original judgment written in French and reproduced here). »
