On February 11, 2004, Mr. Réal Marcotte filed a motion for authorization to institute a class action against the Fédération des caisses Desjardins du Québec. The Respondent illegally charged a fee of 1,8% for each credit card transaction by consumers in foreign currency. The class action seeks the reimbursement of these illegal fees as well as damages and punitive damages. On July 5, 2004, Mr. Justice Israel S. Mass of the Superior Court authorized the institution of the class action. The description of the group was modified by Mr. Justice Clément Gascon on March 14, 2008 as follows: "All consumers holding a credit card issued by the Defendant to whom fees were charged between April 17, 2000 and December 31, 2007 for transactions made in foreign currencies before the end of a 21 day period following the sending of a statement of account."
